Canadian teenager gets maximum sentence for killing Filipino immigrant

A Canadian teenager with a long criminal history has received the maximum sentence for the shooting death of Joselito Fernandez, a 53 year old Filipino immigrant.

The 17 year old Indigenous teenager pleaded guilty to second degree murder and will serve seven years of custody and community supervision, the maximum allowed by law.




FILIPINO IMMIGRANT SHOT IN THE BACK

Police investigators found that the teenager and Fernandez had an interaction while the Filipino immigrant was walking along the railway track on April 18, 2019.

Fernandez was running away from the teenager when he was shot in the back. He was later pronounced dead in hospital.

Fernandez’s daughter, Jane, shared her family’s feelings in court during the delivery of the victim impact statement, “What hurts me most is how my dad left this world – by himself with no one at his side. He must have been so scared.”




FILIPINO IMMIGRANT HASN’T BEEN HOME SINCE 1988

Fernandez had never been back to the Philippines since his arrival in Canada, and was making plans to go visit when he was killed.

The convicted teenager plead guilty to second degree murder, in a deal which saw Crown lawyers forgo seeking an adult sentence.




TEENAGER GETS MAXIMUM SENTENCE FOR KILLING FILIPINO IMMIGRANT

The teenager was exposed to domestic violence, drugs and gangs at an early age, with his mother having been released after having served a prison sentence for murder.

Staff at the teenager’s school had earlier raised concerns about his fascination with weapons and videos with violent content.

The judge ordered the teenager to serve four years in secure custody and the rest under community supervision. The teenager is likewise banned from possessing any type of weapon for the remainder of his life.
